In a landmark decision of the NSW Supreme Court, Justice Brereton has found that class action plaintiff shareholders may recover losses if they paid more for shares than they would otherwise have paid, where the market is misled into attributing an inflated value to the shares, and without having to prove that the plaintiff shareholders themselves relied on the relevant misleading statements or omissions. The judgment is the first time an Australian court has embraced the US approach of “market-based causation”.
