The Gilbert + Tobin team is headed by partner, Christopher Flynn who, amongst other areas, specialises in international law. Chris’ team at Gilbert + Tobin is assisted by Adjunct Professor, Dr Christopher Ward, a Barrister specialising in international law at St James’ Hall Chambers in Sydney.
Gilbert + Tobin commenced acting for Mr Greste in late September (after Mr Greste’s initial trial, and after formal written submissions had been made in his Appeal).
Both Gilbert + Tobin and Professor Ward welcome the recent Court of Cassation decision to have the original judgment sent back for retrial.
On 13 November 2014, the President of Egypt issued decree 140/214. The decree allows a President to permit, with the concurrence of parliament, the deportation, to their home country, of accused persons or persons sentenced to serve terms of imprisonment.
An application has been prepared on behalf of Mr Greste seeking his deportation in accordance with the terms of the decree. Our team has been closely involved in preparing, and advising on, this application. We hope that the President gives it every and early consideration. At this stage, we are unaware of timing of any decision on it by the President.
At the same time we are also preparing a vigorous defence of Mr Greste’s case for his re-trial in Egypt if required. We are also investigating and preparing for other avenues of redress for Mr Greste outside of Egypt.
Our team has been working closely with, and has enjoyed the support of, the Foreign Minister and the Department of Foreign Affairs and Trade throughout this process. We look forward to their continued support and engagement going forward.
