She specialises in commercial litigation, trade practices litigation, energy and resources litigation and proceedings involving insolvency issues and restructuring. She has extensive experience in major Supreme Court and Federal Court litigation in NSW, Victoria and Queensland.
Colleen has been named in the Best Lawyers List for Litigation since its inception and is listed as a leading individual in Chambers Asia Pacific 2014 and Benchmark Asia Pacific 2013. Colleen was included on the Australasian Lawyer’s List of Hot 40 Lawyers for 2014.
She has over 20 years’ experience in commercial litigation, including acting in major contracting disputes, arbitrations and managing high-stakes litigation.
Colleen’s recent experience includes:
- Acting for Google Inc (US) in defending proceedings brought by the ACCC regarding alleged misleading and deceptive conduct over sponsored links which appear on Google’s search result pages. This is one of the world’s leading cases in online advertising and the responsibility of search engines and Google was successful on all counts in the High Court of Australia.
- Successfully representing AGL Limited in proceedings brought in the Supreme Court of Queensland (and the Court of Appeal in Queensland) in relation to a claim for force majeure under a long term gas contract in relation to the exploration and development of coal seam methane gas.
- Representing eight RiverCity companies in proceedings against AECOM Australia in the Federal Court of Australia, alleging misleading and deceptive conduct and negligent misstatement, and seeking over $1.7 billion in damages in relation to the Clem 7 Tunnel in Brisbane. The litigation against AECOM is one of the largest commercial disputes in Australia, and is the first case in Australia brought by a privately-funded operator of a failed toll road. We are also defending RiverCity in a related class action, and prosecuting a related claim for Portigon AG, worth over $350 million.
- Acting for publicly listed companies involving proceedings relating to the recovery of taxation.
- Advising companies and professional advisers involved in investigations and litigation by both the Australian and Securities Investments Commission (ASIC) and the Australian Competition and Consumer Commission (ACCC), and also advising companies in respect of Schemes of Arrangements.
- Representing major corporates in complex joint venture, shareholder and contractual disputes and in major arbitrations.
