Biography
Claire Scanlon is a special counsel in our Energy, Resources and Infrastructure Group.She provides strategic and commercial advice to government and private sector clients on the procurement of major construction and infrastructure projects across the social infrastructure, transport, water and renewable energy sectors. She has extensive experience advising on projects procured under a public–private partnership (PPP) model.
Claire brings both private practice and in-house experience and has significant expertise in drafting and negotiating a broad range of commercial contracts, including project agreements, construction, operation and maintenance agreements and ancillary project documentation. She has a strong understanding of the key legal and commercial issues arising on major construction and infrastructure projects.

Claire’s experience includes advising:
- Honeywell Limited on its involvement as the hard facilities management contractor in the successful Capella led consortium for the $1.1 billion Frankston Hospital Redevelopment PPP.
- Honeywell Limited on its involvement as the hard facilities management contractor in the successful Capella led consortium for the Melton Hospital PPP.
- Icon Construction on its involvement as the design and construct contractor in the successful Tetris led consortium for each of the Ground Lease Model 1 and 2 PPP Projects.
- Kane Construction on its involvement as design and construct contractor in the Tetris led consortium for the Geelong Convention and Event Centre PPP Project.
- McConnell Dowell on its involvement as the civil works design and construct contractor; in each of the following; the successful Bombardier led consortium for the Queensland New Generation Rolling Stock PPP project; the Bombardier led consortium for its bid on the North West Rail Link PPP project; and the Balfour Beatty led consortium for its bid on the Sydney Light Rail PPP project.
- Corys on its involvement as the simulator supplier in the successful RailConnect consortium for the NSW Interfleet PPP project and in the successful Plenary led Evolution Rail consortium for the Victorian High Capacity Metropolitan Trains PPP project.
- The Department of Transport (Vic) in relation to the Melbourne Metropolitan Rail Franchising Project (MR3) involving its retendering of the Metropolitan train and tram franchises.
- Essential Energy on its involvement as the O&M contractor in the bid by Plenary to deliver the Central West Orana Renewable Energy Zone (CWO REZ).
- Essential Energy’s subsidiary Intium on its involvement in the Forest Glen Solar Farm project, providing the design, construction, commission and operation of assets to connect the solar farm infrastructure to the Essential Energy electricity network.
- Canadian Solar’s e-storage business on various tenders to design, build and operate battery storage systems, including the Summerfield BESS project in South Australia with Copenhagen Infrastructure Partners and the Tailem Bend 3 BESS project in South Australia with Vena Energy.
- DEECA on all legal aspects of the South-East Melbourne Advanced Waste Processing project.
- Veolia on the drafting and negotiation of a 15-year term operation and maintenance contract with Central Highlands Water in respect of six water treatment plants in the Central Highlands region.
- Veolia on the drafting and negotiation of the contract to build, own and operate a state of the art materials recycling facility (MRF) in Hume, ACT valued at over $850 million. The facility will recycle 1.3 million tonnes of materials over 20 years, which equates to a reduction of 520.000 tonnes in greenhouse gas emissions.
