Daniel Moloney

Biography

Daniel is a partner in our Disputes and Investigations group.

He specialises in high-value, high-profile and complex litigation.

Daniel has extensive experience advising corporates, financial institutions and boards in relation to major commercial disputes and class actions. He has advised clients in relation to actual or threatened class actions concerning data breaches, AML/CTF issues, shareholder claims, credit ratings, and product liability.

Daniel has regularly advised clients in relation to their most significant investigations and contentious regulatory matters involving Australian and foreign authorities (including ASIC, APRA, AUSTRAC, ATO, ACCC and OAIC).

Experience

Daniel’s experience includes advising:

  • WiseTech, Jaguar Landrover, Uber and S&P Global on class action defence.

  • Insignia, BNP Paribas, Westpac, Crown Resorts, Star Entertainment, DBRS Morningstar, Convera, Brighter Super, Bank of Queensland, Chevron and Experian on regulatory and enforcement representations for corporates and directors.

  • Commonwealth Games entities in claims against the State of Victoria on the cancellation of the 2026 Commonwealth Games, settled for $380 million.

  • Former CEO of Westpac on regulatory investigations and the defence of class actions concerning AML/CTF matters.

  • Jacobs Group Australia (formerly Sinclair Knight Merz) on a landmark foreign bribery matter in Australia.

  • Former Chair of Insignia on the successful defence of APRA disqualification proceedings.

  • A global corporation on domestic and international law remedies following an Australian Government decision to exclude the company from participating in Australian infrastructure opportunities.

  • Sumitomo Mitsui Banking Corporation on claims relating to the Forum Finance fraud.

  • Kraft Heinz on disputes with Bega Cheese arising out of the global restructure of Kraft Heinz/Mondelez and subsequent sale of Mondelez’s Australian business.

  • The receivers of NewSat, a formerly publicly listed Australian satellite company, on a claim against the NewSat CEO and Chairman for breaches of directors’ duties.

  • Bank of Queensland in the Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry.
