Lucy Zimdahl

Biography

Lucy is a special counsel in our Energy, Resources and Infrastructure group.

She is a tenacious litigator and has practiced throughout Australia and in the UAE and the United Kingdom for domestic and international clients on global disputes. She has a wealth of expertise in all forms of dispute resolution, having acted in high-value and complex arbitrations (investment treaty, international and domestic), litigations (including appellate work), expert determinations and adjudications.  

Lucy specialises in disputes in the construction, infrastructure and energy sectors and assists a range of clients on matters concerning the development of projects involving renewable energy (solar and wind), transport (rail and road), mining, energy transmission, freight and logistics and high-end commercial and retail developments. 

Prior to joining G+T, Lucy spent four years as a Senior Associate at another top tier law firm in Sydney and four years as a qualified Associate at a Magic Circle firm’s London and Dubai offices. She has a (joint honours) Bachelor of Law and Spanish from the University of Edinburgh and has been admitted to practice in both England & Wales and NSW. 

Experience

Lucy’s experience includes advising:

  • Elecnor Australia in Supreme Court (NSW) proceedings relating to the Goyder wind farm project (SA) against:

    • the Principal in misleading and deceptive conduct proceedings

    • its joint venture partner, GE.

  • MP Water Supreme Court (NSW) litigation in relation to its A$1 billion project for the build and operation of a water treatment plant at the Springvale Mine in New South Wales.

  • Tianlong Ribbon on a complex, multi-party insurance and construction dispute against a builder and developer currently in external administration in connection with a luxury hotel in Darling Harbour.

  • Representing the contractor in a series of time and cost disputes arising out of the development of a $3.6 billion resort development in Queensland.

  • Defending proceedings brought by a JV contractor on disputed extension of time and cost claims arising out of one of Australia's largest transport infrastructure projects (ACICA arbitration).

  • Representing the concessionaire in litigation in the New South Wales Supreme Court arising out of alleged defects associated with a major New South Wales road tunnel.

  • Acting as project counsel for the concessionaire on pre and post-completion matters (including defects liability claims) arising out of a major Sydney road tunnel PPP.

  • Advising the state in an expert determination in relation to the decommissioning of a NSW power station.

  • Defending an ASX-listed coal mining company on representative proceedings commenced in relation to the disputed viability of various tenements in New South Wales and Queensland.

  • Representing a number of infrastructure funds and private equity investors in claims brought under the Energy Charter Treaty in relation to investments in renewable energy infrastructure in the Kingdom of Spain (ICSID arbitrations) (claims totalling between €220-400 million).

  • Defending a major international shipbuilder on multiple disputes arising out of the construction of one of the world’s largest and most expensive super yachts (LMAA arbitration).

  • Representing the Principal in ICC arbitration proceedings arising out of a FIDIC contract relating to the expansion of a container terminal in the Middle East (claims and counterclaims totalling apx. US$50 million) (ICC arbitration).
