Sam Harvery

Biography

Sam is a special counsel in our Employment group.

He advises on work health and safety and employment issues of all types. He has extensive transactional and litigation experience, particularly in relation to disputes such as claims under the Fair Work Act 2009 (Cth), and breach of contract claims such as post-employment restraint and confidentiality obligations. Sam is an Accredited Specialist in Employment & Industrial Law under the Law Society of NSW’s Specialist Accreditation Scheme.

Sam provides clear and commercial advice on business-critical employment issues that are often highly sensitive, and which carry both legal and reputational risk to clients.

He advises clients across all sectors, with a particular interest in private equity, professional services and consumer and retail.

Experience

Sam’s experience includes advising:

  • Macquarie Asset Management on complex industrial relations issues arising in its $11.7 billion acquisition of Qube Holdings.
  • EG Australia on industrial relations matters arising in the course of its $1.1 billion acquisition by Ampol.
  • A technology company on a whistleblower matter involving complex foreign law issues.
  • A large retailer in relation to claims of sexual harassment, sex discrimination, a hostile work environment and breaches of work health and safety legislation brought by two employees.
  • A publicly-listed company in the financial services sector in securing freezing orders over the assets of a former employee in respect of the misappropriation of more than $1 million.
  • The comedian and radio presenter Lawrence Mooney in respect of Supreme Court proceedings.
  • A well-known Australian musician regarding their exit from their band, involving proceedings in the Fair Work Commission.
  • The Kid Laroi regarding a court dispute with his former manager.
