Biography
Daniel is a special counsel in our Energy, Resources and Infrastructure group.He has extensive experience running disputes in the construction, infrastructure and energy space in all Australian jurisdictions. Daniel regularly acts for Tier 1 and 2 contractors as well as developers.
Experience
Elecnor on ongoing project counsel roles in relation to the approximately A$3.6 billion Project Energy Connect, including strategic high-value claims, operational and WHS issues, labour agreements and other front-end, commercial and contentious matters following the voluntary administration of joint venture partner Clough.
Acciona on construction disputes relating to the Kwinana and East Rockingham waste-to-energy facilities, including WA Supreme Court and Federal Court proceedings concerning claims by and against project counterparties, enforcement of bank guarantees and issues of equitable relief and contractual performance.
Lendlease Construction – RAAF Darwin and Robertson Barracks Solar Farms: acted for Lendlease Construction in Supreme Court of NSW proceedings in respect of two solar farm projects in the Northern Territory.
Lendlease Construction – New Performing Arts Venue: acted for Lendlease Construction as project counsel in respect of state significant project in Brisbane, Qld.
Lendlease Construction – Cairns Convention Centre Expansion: acted for Lendlease Construction as project counsel in respect of state significant project in Cairns, Qld.
Holcim – Trangie Nevertire Irrigation Scheme: acted for global building products supplier in Federal Court of Australia proceedings.
Acciona – Pacific Highway Upgrade (Warrell Creek to Nambucca Heads): acted for JV head contractor (Acciona & Ferrovial) in Federal Court proceedings concerning a disputed claim for indemnity cover for weather damage during the construction of a $550m highway upgrade in Northern NSW.
Springvale Mount Piper Power Station: acted for the SPV project company (MP Water) in several complex and high value proceedings in the Supreme Court of NSW, NSW Court of Appeal and High Court concerning a water treatment facility servicing the Mount Piper Power Station including successful proceedings concerning enforcement of step in rights.
Canberra Light Rail: acted for global design consultant (AECOM) in major dispute for Canberra Light Rail (Stage 1) project.
Sydney Metro Northwest: acted for a design joint venture on upstream and downstream payment disputes, including carriage of adjudications under security of payment legislation, in respect of multi-billion dollar rapid transport rail project.
